Licenses Permissions

Who is eligible ?

The Commissioner of Police is the Licensing Authority for the area falling in Gandhinagar Police jurisdiction. The Licensing Authority is empowered to grant Arms Licence for validity within Gujarat
For All India Licence MHA is the competent authority
For Non Prohibited bore weapons Licensing Authority of the respective Dist/Cities in the State are competent to grant Arms Licenses.
For Prohibited bore weapons Govt. of India alone is competent to grant Arms Licence.

Who is eligible ?

Any person who is citizen of India and is not below the age of (21) years is entitled to apply for grant of Arms Licence.

How to apply for grant of

Arms Licenses by an individual

Application in prescribed form  duly filled in, should be addressed to Commissioner of Police, Gandhinagar and submitted to the concerned Police Station of Police of their residential areas for its process. Application should accompany with the following documents.

  • Residential proof (viz. Electricity Bill, Water Bill, Telephone Bill, Driving Licence, Passport, Election Voter Id-card, Ration Card, Property/House Tax, PAN Card).
  • 3 passport size photos
  • I.T. return for the last three years
  • Prescribed Licence fee to be paid at SBI Main Branch, Gandhinagar

Arms Licenses for the purpose of Target Sports

Application duly filled in, should be addressed to Commissioner of Police, Gandhinagar and submitted to the concerned Police Stataion for its process. Application should be accompanied with

  • Residential proof (viz. Electricity Bill, Water Bill, Telephone Bill, Driving Licence, Passport, Election Voter Id-card, Ration Card, Property/House Tax, PAN Card).
  • 3 passport size photos
  • I.T. return for the last three years
  • Prescribed Licence fee to be paid at SBI Main Branch, Gandhinagar

Arms Licenses for the purpose of Target Sports

Application duly filled in, should be addressed to Commissioner of Police, Gandhinagar and submitted to the concerned Police Stataion for its process. Application should be accompanied with

  • Three years participation in sports event of target shooting – document evidence should be enclosed.
  • Residential proof (viz. Electricity Bill, Water Bill, Telephone Bill, Driving Licence, Passport, Election Voter Id-card, Ration Card, Property/House Tax, PAN Card).
  • 3 passport size photos
  • I.T. return for the last three years
  • Prescribed Licence fee to be paid at SBI Main Branch, Gandhinagar

Renewal of Arms Licenses

  • Application for renewal of Arms Licence in the specified format should be submitted one month before the date of expiry of Arms Licence
  • The application should be submitted duly filled in  the concerned Police Station  along with residential proof (viz. Electricity Bill, Water Bill, Telephone Bill, Driving Licence, Passport, Election Voter Id-card, Ration Card, Property/House Tax, PAN Card).
  • Prescribed renewal fee

Sale and replacement of weapon

An individual can apply for sale or replacement of weapon covered by the Arms Licence. Application addressed to the Commissioner of Police, Gandhinagar should be submitted to the respective Police Station for consideration duly mentioning the reasons, grounds for making such an application. No fee is prescribed.

Inclusion of weapon

An individual can possess not more than three (3) weapons covered by an Arms Licence. Grant of Arms Licence for more than one weapon will be considered under special circumstances and depending on the dire need on genuine grounds.

Transfer of weapon from one Licencee to another

A weapon can be transferred from one Licensee to another on the following occasions:

  • By sale of weapon (to produce agreement of sale)
  • By gift (to produce gift deed)
  • To the legal heir In the case of death of licensee (to produce legal heir certificate in the name of the transferee along with NOC from other family members)

An individual can apply for transfer of weapon covered by the Arms Licence. Application addressed to the Commissioner of Police, Gandhinagar should be submitted duly filled in the concerned Police Station for consideration duly mentioning the reasons, grounds for making such an application. No fee is prescribed.

Inclusion of Retainer

An individual or a Firm/Company/Bank etc. can apply for inclusion of retainer in the Arms license for the convenience of the License holder. Application addressed to the Commissioner of Police, Gandhinagar should be submitted duly filled in  the concerned Police Station for consideration duly mentioning the reasons, grounds for making such an application. No fee is prescribed.

Sale of Weapon & cancellation of Licence on request

An individual can apply for sale of weapon and cancellation of licence, at the request of the Licensee on account of old age, no necessity etc. Application addressed to the Commissioner of Police, Gandhinagar should be submitted duly filled in  the concerned Police Station for consideration duly mentioning the reasons, grounds for making such an application. No fees is prescribed.

Extension of time for purchase and production of weapon

After the grant of Arms licence, the Licensee shall purchase and produce the weapon with in the stipulated time given to him, i.e. 3 months generally or as decided by the licensing authority.

If he fails to purchase the same within the given time, he has to make an application to the Commissioner of Police  for extension of time.

Journey licence to carry weapons

Licensees intending to carry weapons from one place to another within or outside State beyond the validity of area permitted in the Arms licence by the respective Licensing Authority should apply for grant of journey licence from the respective Licensing authority of the jurisdiction in which he purchase the weapons to carry the same.

Fire-crackers Explosives License

  • It is issued under Explosive Act, 1884 and Explosive Rules 1983. The applicant must be citizen of India.
  • To obtain license for Fire Crackers or to get it renewed such license from concerned Police Officer.  Under these provisions the applicant citizen has to make an application in prescribed form along with documentary evidences and he has also to pay the prescribed fee it.   On receipt of an application and after due verification and inquiry the license is issued/renewed.

For Hotel/Guest House/Restaurant

Any citizen intending to start the business of Hotel, Guest House and Restaurant, has to obtain the permission / license of the Police Inspector of the jurisdiction.  The Commissioner of Police / The Collector frames the rules for such permission  for  license under the provisions of Article 33(1) of the Bombay Police Act, 1951 and accordingly such a permission / license is given.

The citizen, who is a customer cum passenger of the guest house, uses the guest house for temporary residence and therefore, there are strict provisions in the law to prevent any unlawful activity.  This license or permission is required to be renewed periodically under the provisions of the relevant rules.

Cinema License :-

Cinema is the only important means of entertainment for the public.  The theater or multiplex are run to display the films and therefore, prior to construct a theater, No Objection Certificate is required  to be obtained from the concerned office. It is mandatory to obtain license from the Collector prior to starting a theater.

An application in the prescribed form alongwith necessary document is required to be made for new license under the provisions of the law and in accordance with the relevant rules.  After checking and verification of the site No Objection Certificate is issued by Police.

Performance license

Certificate in respect of Closed Hall/renewal of, Booking of the Hall/ Performance License.

  • For Close Hall (Town Hall, Tagore hall, Dinesh Hall, H.K.Hall,      Thakorebhai Hall etc.)
    • Application Form with Court Stamp of Rs.3/-.
    • Xerox copy of receipt of rent of the Hall.
    • Consent letter of the artist/ Certificate of Cultural Board of Drama hall.
    • Prescribed Challan of Fee after payment of the same at State Bank of India, Lal Darwaja.
  • for Open Party Plot/ Hal
    • Application Form with Court Stamp of Rs.3/-.
    • Xerox copy of receipt of rent of the Hall.
    • Consent letter of the artist.
    • Fire Safety Certificate of the place.
    • Details of Parking/Opinion of Traffic
    • In case of Exhibition and Fun Fair, Certificate of P.W.D./ Insurance/ Security arrangement.
    • Opinion of the Police Station.
  • Pool Parlor/ Health Club/ Amusement Park:

In this respect it may be respectfully stated that, as per the rules framed by the Commissioner of Police under the provisions of License Notification No.888/26, dated 18/04/1962, it is mandatory to obtain license for public places of amusement in the city area of Gandhinagar. Following information/ details are solicited to consider the request for issuing necessary license in this regard:

  • Name and address of the firm under whose name the place of amusement is proposed to be started.
  • Names, residential addresses of the owners/partners of the firm, occupation of the Hall and name and address of the hall.
  • Name and address of the person who functions as a Manager and remains present at the place of amusement.
  • For what timings the place of amusement shall remain open for public.
  • How many persons are allowed to enter at one time at the place of amusement.
  • Whether any Entry Fee is taken from the visitor of the place of amusement. If yes, details of the same.
  • At what rate and for how much time (item wise) charges are taken in Health Club/ Gymnasium.
  • How many equipments have been installed in Health Club/ Gymnasium? Name and number of all such equipments may be mentioned.
  • Name and address of the owner of the place and No Objection Certificate for the proposed occupation.
  • The said place can be used for business purpose that means the said place is for commercial use. Building Use Certificate of Gandhinagar Municipal Corporation or local concerned authority.
  • Names and number of the fire extinguisher equipments purchased and installed at the place.
  • Map of the site with scale and details of the doors and windows for entrance and exit.
  • Map of the proposed site attested by qualified architect/ engineer as a proof of construction.
  • Whether is there any Air Conditioner at the proposed site? If no, then number of exhaust fans installed at the place.
  • Map of the place of parking with scale meant for the vehicles of the customers.
  • Name and address of the owner of the parking place.
  • If the applicant firm is not the sole owner of the parking place, then consent letter of the owner showing the details as to for how many vehicles the applicant is authorized to park.
  • How many persons are to be engaged on duty to ensure parking of the vehicles of the passengers at allotted place.
  • Complete details as to what distance from the place are situated the school or religious place.

Until the procedure for license is completed, it is requested that the place of amusement may not start.

Petroleum License:-

It is mandatory to have a license for purchase / sale or to store the inflammable liquids like petrol, diesel, kerosene or solvent. Since, such a liquid is fetal there are strict provisions made in Petroleum Act, 1934 and Petroleum Rule, 2002. After obtaining No Objection Certificate from explosive department, fire bridge etc. and after verification of the site, the Commissioner of Police / Collector sanctions the Petroleum License.

Permission for Loud Speaker, Sabha, Procession

Permission to various political, religious and other institutes is granted by this office as well as at the level of Police Station for holding Sabha – Procession, Dharna (Fasting), playing Loud Speaker etc. in these cases the application or the organizer has to follow the procedure as mentioned under:

  • Before five days the applicant has to make an application to the office of the Commissioner of Police in a prescribed form. 
  • Procedure for granting permission would be undertaken after obtaining the opinion of the Police Inspector of the concerned area on the basis of the application of the applicant.
  • To hold a public meeting (Sabha) the applicant has to make an application before 5 days and this permission is granted subject to the following conditions.
  • Public meeting (Sabha) is to be undertaken in a peaceful manner.
  • It has to be ensured that orders of the Government are complied with.
  • The public meeting will not be held at place other than for which permission is granted.
  • The public meeting will be held in such a way as may not create obstacle to the traffic.
  • The applicant who has obtained the permission or his representative has to remain present with original letter of permission at the place of such public meeting and he has to submit the original permission in case of verification, if required.
  • If rally or procession is taken out without permission then it is an offence of breach of law under Section 131 of Bombay Police Act, 1951.
  • It shall be the responsibility of the applicant or the organizer to ensure that above said conditions are fully complied with. 

Further more, permission / license in respect of loud speaker / public meeting is granted under the prevailing  rules of the Government.

License for Cyber Cafe

Following documents are required to be submitted to obtain license for Cyber Café along with the application for it

  • License for Shops and Establishments.
  • Certificate regarding place of edible items (if applicable)
  • Grade License (if applicable)
  • Xerox copy of document of partnership of the partnership firm.
  • Receipt of the rent if the place has been taken on rent.
  • Assessment of Tax/ payment of tax and PAN number.
  • It will be the responsibility of the owner of the Cyber Café to ensure that no risky electrical appliances are used.
  • As a part of the public safety, the fire safety equipments would be installed and the same shall be maintained periodically and proof of the same shall be produced.
  • Telephone Bill is required to be submitted supporting that the telephones are being used in the premises.
  • Details of educational institute shall be furnished if situated within the radius of 500 meters of the place.
  • Document showing that the applicant is the owner of the place.
  • Xerox copy of  Memorandum and Articles of Association, if any (If applicable)
  • Certificate showing that the person is the member of the association (Association has to furnish a statement showing the details of all the members and Memorandum of Article of the Association).
  • Certificate issued by I.S.P. showing the details of connection and username along with static IP address allotted (which shall be maintained along with the log book in the cyber café)
  • Certificate issued by I.S.P. showing that the applicant can participate in any way for the service, can resell or can distribute (if applicable)
  • Number of machines installed along with details of all equipments and peripherals (Server, clients, Modems, Scanner, Web Cam, Microphones, etc)  like make and brand of it  along with application form and thereafter if there are any changes then the same shall be noted in the register kept in the cyber café.
  • The user  shall be made to sit in an open place; there will not be any cabins and every partition shall not have the height more than 2.5 feet so that the viewers can be prevented from viewing any objectionable and pornographic websites.
  • Details of internal computers’ networking and peripherals, cite of the network and details of the network and details of internet address shall be noted in the register kept in the Cyber Café.
  • Details of Hardware/ Software Engineer/ Consultant (if applicable).
  • Passport Verification (Details already sent in previous document)
  • Police Verification Certificate (details already sent in previous document)

  • Antecedent Verification
  • In case of candidates recruited in government organization
    • Statement of applicant / parents (Guardian).
    • Statement of two witnesses.
    • Verification of School Certificate
    • Verification of Domicile Certificate.
    • Copies of light bill / telephone bill / tax bill / driving licence / Passport are obtained as evidences. 
  • from private institute / Company for the purpose of job.
    • Paid copy of Challan of prescribed fee
    • Certificate from the Principal of the School for authenticity of documents
    • Statement of the applicant and two witnesses.
    • Proof of residence is obtained.
    • Antecedents of applicant from the concerned Police Station is checked
  • verification for Wireless license.
  • Statement of the applicant and two evidences.
  • Proof of residence is obtained.
  • Antecedents verification from concerned Police Station
  • The visit of the site is got done through Police Inspector (Wireless), Head Quarter
  • Letter of Guarantee is obtained.

After completing above said procedure an opinion is forwarded for it.

Domicile Certificate:

Domicile Certificate is meant for declaring the residence in the State of Gujarat.  To obtain this certificate an applicant has to submit a proof of his continuous stay for 10 years in Gujarat.   To obtain this certificate the following documents are required :

  • Application with prescribed form
  • Birth Certificate
  • Last Leaving Certificate
  • Light Bill of the current month / Municipal Tax Bill or receipt of rent for residential proof.
  • In case of having native of the applicant is outside the State, the applicant has to enclose an Affidavit in English along with the application.
  • If applicant is doing job, certificate on the letter paid of the company / institution about date of joining and leaving the company / institution.
  • Bonafide certificates of all the schools where applicant studied (It is mandatory to mention the date of admission and date of leaving the school).
  • A Passport size photograph should be pasted at the right hand upper side of the application and two more Passport size photographs are required to be enclosed with the application. A Court Stamp of Rs. 1 is required to be pasted on the application.
  • All the papers are required to be presented must be self attested.

Application of the applicant is forwarded to the concerned Police Station for verification and on receipt of the verification report, the applicant is issued Domicile Certificate.
